Welcome to UNFAZED.
These Terms of Service ("Terms") govern your access to and use of the UNFAZED website, online store, products, services, and related features.
Throughout these Terms, "UNFAZED," "we," "us," and "our" refer to Unfazed Clothing LLC, the company operating the UNFAZED online store.
By accessing our website, placing an order, creating an account, or otherwise using our services, you agree to be bound by these Terms and our Privacy Policy, Shipping Policy, and Return & Refund Policy, each of which is incorporated into these Terms by reference.
If you do not agree to these Terms, you should not use our website or purchase our products.
1. ONLINE STORE TERMS
By using this website, you represent that you have the legal capacity to enter into these Terms.
If you are under the age of majority where you live, you may use the website only with the permission and supervision of a parent or legal guardian.
You may not use our website, products, or services for any unlawful, fraudulent, or unauthorized purpose.
2. PRODUCT INFORMATION
Unfazed Clothing LLC makes reasonable efforts to accurately display and describe our products, including:
• Designs
• Colors
• Materials
• Fabric weights
• Measurements
• Sizing
• Graphics
• Garment finishes
• Product photographs
Actual product appearance may vary due to lighting, photography, screen settings, printing techniques, garment washing, dyeing, distressing, manufacturing processes, and normal production variations.
Certain UNFAZED garments intentionally feature washed, distressed, faded, aged, cracked, vintage, or otherwise non-uniform finishes. Reasonable variations resulting from these processes are part of the intended character of the product and are not automatically considered manufacturing defects.
3. PRODUCT AVAILABILITY
All products are subject to availability.
Unfazed Clothing LLC reserves the right to:
• Limit quantities
• Discontinue products
• Modify products
• Change available sizes or variations
• Restrict sales where reasonably necessary
• Correct inventory errors
• Cancel or modify releases
Placing an item in your cart does not reserve that item.
4. ORDERS
Submitting an order does not necessarily constitute final acceptance of the order by Unfazed Clothing LLC.
We reserve the right to review, refuse, limit, or cancel orders when reasonably necessary, including because of:
• Suspected fraud
• Unauthorized payment activity
• Pricing or listing errors
• Inventory shortages
• Production limitations
• Duplicate orders
• Security concerns
• Incorrect customer information
• Abuse of promotions or discount codes
If we cancel a paid order before fulfillment, any refund legally owed will be issued to the applicable payment method.
5. PRICING & PAYMENT
Prices may change without notice.
Applicable taxes, shipping charges, duties, or other charges may be added at checkout.
You agree to provide accurate and complete billing and payment information and represent that you are authorized to use the payment method submitted.
We reserve the right to correct obvious pricing, technical, promotional, or product-listing errors where permitted by law.
Orders may be subject to payment verification and fraud screening.
6. ALL SALES ARE FINAL
ALL UNFAZED SALES ARE FINAL UNLESS THE PRODUCT HAS A VERIFIED MANUFACTURING OR PRODUCTION ISSUE OR APPLICABLE LAW REQUIRES OTHERWISE.
We do not provide returns, refunds, or exchanges because of:
• Change of mind
• Buyer's remorse
• Incorrect size selected by the customer
• Fit preference
• Incorrect color selected by the customer
• Incorrect product selected by the customer
• Failure to review sizing information
• Failure to review a product description
• Normal manufacturing variations
• Normal characteristics of washed, distressed, faded, or vintage garments
• Damage occurring after delivery
Verified manufacturing and production issues are handled according to our separate Return & Refund Policy.
Eligible manufacturing issue claims must be submitted within 30 days of confirmed delivery, except where applicable law requires otherwise.
7. TAPSTITCH & MANUFACTURING
Certain UNFAZED products are manufactured, printed, fulfilled, shipped, and handled through Tapstitch and other third-party providers.
By purchasing from UNFAZED, you acknowledge that third-party manufacturers, fulfillment facilities, logistics providers, and shipping carriers may participate in completing your order.
For misprints, print defects, incorrect print placement, missing artwork, or similar production issues, customers may contact:

Customers should not return merchandise directly to Tapstitch or any manufacturing facility without first receiving return authorization and instructions.
8. SHIPPING & DELIVERY
Shipping and fulfillment are governed by our separate Shipping Policy.
Shipping, processing, and delivery dates are estimates unless expressly identified as guaranteed.
Production time and shipping-carrier transit time are separate.
Customers are responsible for providing a complete and accurate delivery address.
Unfazed Clothing LLC is not responsible, to the fullest extent permitted by law, for delivery problems caused by incorrect or incomplete information supplied by the customer.
Nothing in these Terms limits shipping, cancellation, or refund rights that cannot legally be waived. Federal rules can require online sellers to ship within a promised timeframe—or generally within 30 days when no shipping timeframe is stated—and to provide appropriate cancellation/refund options when required by qualifying delays.
9. ORDER CHANGES & CANCELLATIONS
Orders may enter production shortly after being placed.

as quickly as possible.
Submitting a cancellation or modification request does not guarantee that the request can be completed.
Once production or fulfillment has begun, an order may no longer be eligible for cancellation or modification, except where required by law.
10. CUSTOMER ACCOUNTS
If customer accounts are available, you are responsible for protecting your login information and maintaining the confidentiality of your account.
You agree to provide accurate information and promptly update information that changes.
We may suspend or restrict accounts reasonably associated with:
• Fraud
• Unauthorized activity
• Payment abuse
• False claims
• Website abuse
• Violations of these Terms
11. DISCOUNTS, GIVEAWAYS & PROMOTIONS
Promotions, discount codes, giveaways, contests, and special offers may be governed by additional terms.
Unless specifically stated otherwise:
• Promotional codes have no cash value
• Discounts cannot be applied retroactively
• Discounts may not be combined
• Offers may be limited by customer, product, quantity, or date
• Promotions are subject to availability
• Fraudulent or manipulative participation may result in disqualification or cancellation
12. INTELLECTUAL PROPERTY
The UNFAZED website and its content, including our branding, artwork, graphics, clothing designs, photographs, videos, text, product descriptions, creative materials, logos, website elements, and other original content, are owned by, licensed to, or otherwise lawfully used by Unfazed Clothing LLC.
Except as expressly permitted, you may not copy, reproduce, modify, manufacture, distribute, sell, publish, commercially exploit, or create derivative merchandise from UNFAZED content without prior written authorization.
You may not use UNFAZED intellectual property in a manner that falsely suggests sponsorship, authorization, endorsement, affiliation, or partnership.
All rights not expressly granted are reserved.
13. COUNTERFEIT & UNAUTHORIZED MERCHANDISE
The unauthorized manufacture, reproduction, distribution, or sale of merchandise incorporating protected UNFAZED artwork, designs, logos, branding, or other intellectual property is prohibited.
Unfazed Clothing LLC reserves the right to investigate suspected infringement and pursue remedies available under applicable law.
14. PROHIBITED USES
You may not use the UNFAZED website or services to:
• Commit or facilitate fraud
• Use unauthorized payment information
• Attempt unauthorized access to our systems
• Introduce malware or malicious software
• Interfere with website security
• Impersonate another person
• Provide materially false information
• Manipulate promotions
• Submit fraudulent manufacturing or refund claims
• Infringe intellectual-property rights
• Use automated purchasing tools or bots in violation of posted release rules
• Scrape protected content for unauthorized commercial purposes
• Engage in unlawful activity
We reserve the right to restrict or terminate access for violations of these Terms.
15. REVIEWS & USER-SUBMITTED CONTENT
If you voluntarily submit reviews, photographs, videos, testimonials, comments, or other content to UNFAZED for publication, you represent that you have the right to submit that content.
You retain ownership of your original content.
By submitting content for publication or promotional use, you grant Unfazed Clothing LLC a non-exclusive, worldwide, royalty-free license to reproduce, display, publish, distribute, adapt, and use that content in connection with UNFAZED marketing, advertising, social media, websites, and promotional materials, unless otherwise agreed in writing.
You may not submit unlawful, fraudulent, defamatory, infringing, obscene, threatening, or malicious content.
16. THIRD-PARTY SERVICES
Our store may use third-party services including:
• Shopify
• Tapstitch
• Payment processors
• Shipping carriers
• Analytics providers
• Marketing platforms
• Social-media platforms
• Other ecommerce and technology providers
Unfazed Clothing LLC does not control every aspect of third-party services.
Your interaction with third-party platforms may also be governed by their own terms, privacy policies, and procedures.
To the fullest extent permitted by law, Unfazed Clothing LLC is not responsible for the independent acts, omissions, outages, policies, or services of third parties that are outside our reasonable control.
17. PRIVACY
Our collection, use, and disclosure of personal information are described in our separate Privacy Policy.
By using the website, you acknowledge that information necessary to process, manufacture, fulfill, ship, secure, and support your order may be processed by Unfazed Clothing LLC and applicable service providers.
18. WEBSITE AVAILABILITY
We do not guarantee that the UNFAZED website will always be available, uninterrupted, secure, or error-free.
We may temporarily suspend, modify, update, or discontinue website functionality without notice when reasonably necessary for maintenance, security, business operations, or other legitimate purposes.
19. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by applicable law, the website and its content are provided on an "as is" and "as available" basis.
Except for warranties or rights that cannot legally be excluded, Unfazed Clothing LLC disclaims implied warranties relating to the website or services, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the extent legally permitted.
Nothing in this section excludes any warranty or consumer protection that applicable law prohibits us from disclaiming.
20. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Unfazed Clothing LLC and its owners, officers, employees, affiliates, contractors, service providers, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the website or purchase of our products where such damages may lawfully be excluded.
Where liability may lawfully be limited, the aggregate liability of Unfazed Clothing LLC arising from a particular product order will not exceed the amount actually paid to Unfazed Clothing LLC for the product or order giving rise to the claim.
These limitations do not apply where applicable law prohibits the exclusion or limitation of a particular form of liability.
21. INDEMNIFICATION
To the fullest extent permitted by law, you agree to indemnify and hold harmless Unfazed Clothing LLC and its affiliates, owners, officers, employees, contractors, and agents from third-party claims, liabilities, damages, losses, and reasonable expenses arising from:
• Your unlawful use of our website
• Your violation of these Terms
• Your infringement of another party's rights
• Fraudulent activity conducted through your account
• Content you submit that infringes another person's rights
This provision does not require you to indemnify Unfazed Clothing LLC for liability that applicable law does not permit us to shift to you.
22. FRAUD & CHARGEBACKS
If there is an issue with an order, customers are encouraged to contact:

so that we can investigate the issue.
Submitting a payment dispute or chargeback does not automatically establish that a refund is owed.
Unfazed Clothing LLC reserves the right to provide relevant documentation to payment processors, card networks, banks, or financial institutions when responding to disputes, including:
• Order records
• Checkout information
• Tracking
• Delivery confirmation
• Product information
• Customer communications
• Submitted photographs
• Manufacturing records
• Refund-policy information
• Other relevant transaction records
Fraudulent chargebacks, false claims, or misuse of payment-dispute procedures may result in restrictions on future purchases where permitted by law.
23. TERMINATION
We may suspend or terminate access to our website or customer-account features when we reasonably believe that a user has violated these Terms, committed fraud, threatened the security of our services, or engaged in unlawful conduct.
Provisions that by their nature should survive termination—including intellectual-property provisions, liability limitations, payment obligations, and dispute-related provisions—will continue to apply.
24. GOVERNING LAW
These Terms and your use of our services will be governed by the laws applicable to Unfazed Clothing LLC, without giving effect to conflict-of-law principles, except where mandatory consumer-protection laws require otherwise.
Nothing in these Terms deprives a customer of protections that legally cannot be waived.
25. SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent legally permitted or severed as necessary.
The remaining provisions will continue in full force and effect.
26. NO WAIVER
If Unfazed Clothing LLC does not immediately enforce a provision of these Terms, that does not constitute a waiver of our right to enforce that provision later.
27. ENTIRE AGREEMENT
These Terms, together with our:
• Privacy Policy
• Shipping Policy
• Return & Refund Policy
• Any additional terms expressly applicable to a particular promotion or service
constitute the agreement governing your use of the UNFAZED online store and related services.
28. CHANGES TO THESE TERMS
Unfazed Clothing LLC may update these Terms from time to time to reflect changes to our business, website, products, services, or legal obligations.
Updated Terms will be posted on our website with a revised effective date.
Changes will apply prospectively except where applicable law permits or requires otherwise.
